General conditions of sale and delivery times

General Terms and Conditions of Sale – Sunnyshop211

Effective from: 1 August 2026

These General Terms and Conditions of Sale, hereinafter the “Terms”, govern sales made through www.sunnyshop211.com between Sunnyshop211 and any natural person acting for purposes outside their trade, business, craft or profession, hereinafter the “Customer”.

Article 1 – Seller’s identity

Trading name: Sunnyshop211
Entrepreneur’s full name: Stéphanie Leborgne
Legal status: Sole trader
SIREN/SIRET: 82805324900011
Business address: 730 rue Carlet, 27310 Bourg-Achard, France
Email address: [email protected]

VAT not applicable pursuant to Article 293 B of the French General Tax Code, for as long as Sunnyshop211 benefits from the French VAT exemption scheme.

Article 2 – Purpose and acceptance of the Terms

These Terms define the rights and obligations of Sunnyshop211 and the Customer in connection with the online sale of handmade creations, dolls, doll parts, furniture, dioramas, scenery and miniature accessories.

The Customer declares that they have read these Terms before confirming their order. Confirming the order constitutes unconditional acceptance of these Terms.

The applicable Terms are those in force on the date of the order. Sunnyshop211 may amend them at any time, without such amendments applying retroactively to contracts already concluded.

Article 3 – Product characteristics

The essential characteristics, dimensions, materials, colours, options, compatibility and production times are stated on each product page.

Sunnyshop211 products are handmade. Slight differences in colour, texture, paintwork or finish may therefore exist between the photographs and the item received. Such variations inherent in handmade production do not constitute a lack of conformity provided that they do not affect the essential characteristics advertised.

Photographs are presented as accurately as possible, but colours may appear differently depending on the screen used.

The products sold are intended exclusively for adults and collectors. They are miniature collectors’ and decorative items and are not toys, unless expressly stated otherwise. They are not intended for children and may contain small parts or magnets presenting, in particular, a risk of ingestion.

The Customer must check the dimensions and compatibility of the item with their doll or setting before ordering. This provision does not limit the applicable statutory guarantees.

Article 4 – Prices

Prices are stated in euros. Where the website displays a conversion into another currency, it is for information purposes only; the amount actually charged may depend on the exchange rate and fees applied by the Customer’s payment provider.

Delivery charges are shown before the order is finally confirmed.

Sunnyshop211 may change its prices at any time. The price charged remains the price displayed when the order was confirmed, subject to the correction of an obvious pricing error of which the Customer would be informed before dispatch.

Any customs duties, import taxes and charges imposed by the destination country are not included in the price unless otherwise stated. They are payable by the recipient. Their amount is determined by local authorities and cannot be guaranteed by Sunnyshop211.

Article 5 – Orders

The Customer selects the products and options required, checks the contents of their basket, provides the necessary information, accepts these Terms and proceeds with payment.

Before final confirmation, the Customer can check and correct the details of the order. The Customer is responsible in particular for checking the delivery address and selected options.

The order becomes final once payment has been confirmed and a confirmation email has been sent, subject to the Customer’s mandatory statutory rights, including the right of withdrawal where applicable.

Sunnyshop211 may refuse or cancel an order for a legitimate reason, including a payment incident, manifestly incorrect information, an unlawful request, suspected fraud or an unresolved previous dispute. The Customer will be informed and any sums received for products not supplied will be refunded.

Article 6 – Payment

The price is payable when the order is placed using the payment methods offered on the website, including bank card and PayPal.

Where payment by instalments is offered, the relevant terms and due dates are stated before the order is confirmed. Dispatch may be postponed until payment has been made in full if this condition was clearly notified to the Customer.

The order will only enter production or be prepared after payment has been effectively confirmed, unless otherwise agreed in writing.

For a special order prepared on the basis of a quotation, the payment terms and, where applicable, the classification of any advance payment as a deposit or earnest money will be stated in the quotation. Such terms may not deprive the Customer of mandatory statutory rights.

Article 7 – Handmade production and special orders

Some products are made after the order has been placed. The mere fact that an item is made after ordering does not necessarily mean that it is legally personalised.

The choice of a size, colour or finish from predetermined options offered on a product page is treated as a standard option, unless a particular situation is legally justified.

A “special order” means a non-prefabricated creation made in accordance with an individual request from the Customer that is not one of the standard options offered in the catalogue, for example:

  • specific dimensions provided by the Customer;

  • an engraving, name or personal wording;

  • a specific alteration to an existing design;

  • a shape, colour or finish specially designed at the Customer’s request;

  • a unique creation made according to individual instructions agreed with Sunnyshop211.

The characteristics, price and lead time of a special order are confirmed in writing before payment. Where the item falls within the exception provided for in Article L. 221-28(3) of the French Consumer Code, the absence of a right of withdrawal is clearly brought to the Customer’s attention before the order is concluded.

Article 8 – Production and dispatch times

As most products are handmade, processing time is required before dispatch. Unless a different period is stated on the product page or agreed in writing, the usual production times are:

  • furniture and doll parts: up to 4 weeks;

  • dioramas: 5 to 6 weeks;

  • miniatures: 4 to 5 weeks;

  • BJDs: up to 2 months;

  • special orders: period communicated before confirmation of the order.

Production time also depends on the number of items ordered. An order containing several creations may therefore require more time than the individual periods stated above. The total applicable period is displayed or communicated to the Customer before the order is confirmed and repeated in the order confirmation.

Times are calculated excluding weekends and public holidays. Two additional weeks must be added to the above production times for any order placed during July or August. Any other exceptional extension will be announced on the website and/or product page before ordering.

If no delivery date or period has been announced, delivery will take place no later than thirty days after the contract is concluded, in accordance with applicable law.

In the event of delay, the Customer has the rights provided for in Articles L. 216-1 et seq. of the French Consumer Code. In particular, the Customer may request performance within an additional reasonable period and then terminate the contract if Sunnyshop211 fails to perform within that period. Immediate termination remains possible in the circumstances provided for by law.

Article 9 – Delivery

Delivery is made to the address provided by the Customer when ordering, using the delivery methods offered on the website.

The Customer must report any address error promptly. If the parcel has not yet been dispatched, the address may be corrected. Costs caused by an incorrect or incomplete address supplied by the Customer may be charged when a new dispatch is necessary, without prejudice to the Customer’s statutory rights.

The risk of loss or damage passes to the Customer when they physically take possession of the parcel, except where the Customer appoints a carrier of their own choice that was not offered by Sunnyshop211.

If a parcel is visibly damaged, incomplete or open, the Customer is invited to take photographs, make reservations with the carrier and contact Sunnyshop211 promptly. Failure to make reservations with the carrier does not deprive a consumer of their statutory guarantees.

In the event of loss or damage during transport arranged by Sunnyshop211, the Customer must contact Sunnyshop211 so that a claim can be made against the carrier. Sunnyshop211 remains the Customer’s point of contact for proper performance of the order.

Article 10 – Right of withdrawal for standard items

In accordance with Article L. 221-18 of the French Consumer Code, a consumer Customer has fourteen days from receipt of the goods to exercise their right of withdrawal without giving any reason.

Where several goods from the same order are delivered separately, the period begins upon receipt of the final item. The Customer may also notify their decision to withdraw before delivery.

The request must be sent to [email protected], using the form at the end of these Terms or any other unambiguous statement expressing the decision to withdraw.

The Customer must return the products without undue delay and no later than fourteen days after communicating their decision. Upon receiving the withdrawal request, Sunnyshop211 will provide the practical return instructions and the return address. Contacting Sunnyshop211 does not constitute a condition for the validity of a withdrawal expressed within the statutory period.

Direct return costs are payable by the Customer, provided that the Customer was informed of this before ordering. The Customer must retain and, at Sunnyshop211’s request, provide proof of return dispatch. Tracked shipping and insurance appropriate to the value of the items are strongly recommended to ensure traceability and compensation in the event of loss or damage during return transport.

Products must be returned complete, with any accessories, and properly protected. The Customer may handle a product only to the extent necessary to establish its nature, characteristics and proper functioning. The Customer may be liable for any diminished value caused by handling beyond what is necessary. Any deduction must correspond to the actual loss in value and be substantiated by Sunnyshop211, in particular with photographs and objective evidence. It may not result in an automatic refusal of the entire refund where the item retains value.

Sunnyshop211 will refund the sums due, including the initial delivery costs corresponding to the least expensive standard delivery method offered, no later than fourteen days after being informed of the decision to withdraw. Any supplement resulting from the Customer’s choice of a more expensive delivery method will not be refunded.

The refund will be made using the same payment method as used for the order, unless the Customer expressly agrees to another method that does not incur any fees. Sunnyshop211 may withhold the refund until the goods have been recovered or sufficient proof of their dispatch has been provided, whichever occurs first.

Payment fees and commissions borne by Sunnyshop211 will not be deducted from the refund due to the Customer.

The right of withdrawal also applies to sale or promotional items where they do not fall within a statutory exception.

Article 11 – No right of withdrawal for certain special orders

In accordance with Article L. 221-28(3) of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalised.

This exception applies only to orders that genuinely meet the conditions stated in Article 7. It does not automatically apply to all handmade products or all items made after ordering.

Before such a special order is concluded, Sunnyshop211 will clearly inform the Customer that no right of withdrawal applies and will retain evidence of the individual characteristics agreed.

This exclusion does not deprive the Customer of the statutory guarantee of conformity or the guarantee against hidden defects.

Article 12 – Returns outside the right of withdrawal

Before returning any item, the Customer is invited to contact Sunnyshop211 at [email protected], stating the order number and reason for the request.

This contact allows the appropriate return address and precautions to be provided but cannot limit the exercise of a statutory right.

Outside the right of withdrawal and statutory guarantees, requests for an exchange or return for personal convenience may be accepted by Sunnyshop211 on a case-by-case basis. Any terms offered will be communicated in writing.

Article 13 – Statutory guarantees

Consumers benefit from the statutory guarantee of conformity provided for in Articles L. 217-3 et seq. of the French Consumer Code and from the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

If a product is received defective, damaged or not as ordered, the Customer must contact Sunnyshop211 at [email protected], preferably enclosing photographs and the order number to facilitate processing.

Where a statutory guarantee applies, the consumer will not bear the costs necessary to implement it.

Rights arising from statutory guarantees apply independently of any commercial warranty that may be offered.

Article 14 – Liability

Sunnyshop211 is responsible for the proper performance of the obligations arising from the contract under the conditions provided for by law.

Subject to mandatory statutory provisions, Sunnyshop211 cannot be held liable for damage caused by misuse, assembly contrary to the instructions, an alteration made by the Customer, lack of maintenance or use inconsistent with the product’s advertised purpose.

The Customer remains responsible for the choice of scale and compatibility where the necessary dimensions and information were clearly provided before ordering.

Sunnyshop211 products are intended exclusively for adults and collectors. They must not be entrusted to children and must be kept out of their reach, particularly because they may contain small parts and magnets.

Article 15 – Force majeure

Neither party may be held liable for delay or failure to perform resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code.

The prevented party will inform the other party as soon as possible. If the impediment is temporary, performance is suspended unless the resulting delay justifies termination of the contract. If the impediment is permanent, the contract is automatically terminated under the conditions provided for by law.

Article 16 – Intellectual property

The creations, designs, photographs, texts, illustrations, collection names and graphic elements presented by Sunnyshop211 remain protected by applicable intellectual property rights.

Any unauthorised reproduction, adaptation, manufacture, distribution or exploitation is prohibited, subject to statutory exceptions.

Purchasing a product does not transfer any intellectual property rights attached to its creation.

Article 17 – Personal data

Personal data collected is used to process orders, arrange delivery, manage customer relations, meet accounting and legal obligations and, where the Customer has consented, send marketing communications.

The Customer may exercise their rights of access, rectification, erasure, restriction, objection and, where applicable, portability by writing to [email protected].

Detailed information about processing, retention periods, recipients and cookies is provided in the website’s privacy policy.

Article 18 – Complaints and consumer mediation

For any complaint, the Customer must first contact Sunnyshop211 at [email protected] in an attempt to find an amicable solution.

Following a prior written complaint that has not been resolved satisfactorily, the consumer may use, free of charge, the consumer mediator appointed by Sunnyshop211:

Consumer mediator: CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice
Address: 49 rue de Ponthieu, 75008 Paris, France
Website: https://www.cm2c.net

Referral to the mediator is subject to the mediator’s conditions. Sunnyshop211 must have validly joined the stated mediation service before publishing its details.

The Customer may also use the official SignalConso platform to report a problem encountered with a trader.

Article 19 – Applicable law and disputes

These Terms and contracts concluded with Sunnyshop211 are governed by French law, without depriving a consumer resident in another country of any more protective mandatory provisions applicable to them.

In the event of a dispute, the parties will first seek an amicable solution. If no agreement is reached, the consumer may bring proceedings before the court having jurisdiction under the applicable statutory rules. Nothing in these Terms limits the consumer’s right to bring proceedings before a competent court.
